Leachco Inc., a privately-owned company, (“Leachco”, “We,” “Us,” “Our”) provides this Privacy Policy to advise you regarding our efforts to protect your personal information. This Privacy Policy governs

- “Other Device Information” - We may collect information about your mobile device and internet connection, including the device’s unique device identifier, IP address, operating system, browser type, mobile network information, mobile device ID, mobile device type, mobile device model, mobile device operating system version, device’s location, device’s time zone, and the device’s telephone number. Specifically, we collect your IP address for security purposes.

If you do not want us to collect this information, do not authorize third party applications, do not register with, access, or use our Services.

Personal Information You Provide to Us.

Additionally, when you register for our email newsletter or paper catalogue, create a User Account on our Website, or make a purchase or attempt to purchase a Product through Leachco.com, we utilize SSL Secure and PCI compliant databases to collect specific information from you, including your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number, or any other identifier by which you may be contacted online or offline.  We refer to the purchasing information as “Order Information.”

When we talk about “Personal Information” in this Privacy Policy, we are referring to both about “Device Information” and “Order Information.”

You may also provide information content (e.g., Customer Reviews) to be published or displayed (” Posted”) on public areas of websites you access through our Services (collectively, “User Contributions”). Your User Contributions may, but not necessarily, contain personal information. Your User Contributions are Posted and transmitted to others at your own risk. Although you may set certain privacy settings for such information by logging into your User Account, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of third parties with whom you may choose to share your User Contributions. How Does Leachco use your Personal Information?

We use Personal Information that we collect to

• Identify you when you login to your User Account on our Website’
• Enable us to operate the Services and provide them to you;
• Improve our Site and the Services we provide to you;
• Email you regarding lost passwords, requested customer reviews, product updates, and other matters important to the fulfillment of our Services;
• Mail our catalogue;
• Fulfill any orders placed through the Leachco.com (including processing your payment information, arranging for shipping, and providing you with invoices and order confirmations);

Legal Basis for Use of Personal Information

We process personal information from you where:

• we need the personal information to perform a contract with you (e.g., to deliver the Leachco Services you have requested), or
• the processing is in our legitimate interests (and not overridden by your data protection interests or fundamental rights and freedoms).

 In some cases, we may also have a legal obligation to collect personal information from you, or may otherwise need the personal information to protect your vital interests or those of another person. Where we rely on your consent to process personal information, you have the right to withdraw or decline your consent at any time. Please note that this does not affect the lawfulness of the processing based on consent before its withdrawal. If we ask you to provide personal information to comply with a legal requirement we will make this clear at the relevant time and advise you whether the provision of your personal information is mandatory or not (as well as of the possible consequences if you do not provide your personal information). We do not sell your personal information to third parties. We may disclose aggregated information about our users, and information that does not identify any individual or device, without restriction.   • Google® Analytics. https://policies.google.com/privacy?hl=en. Our website uses Google Analytics, a service which transmits website traffic data to Google® servers in the United States. Google® Analytics does not identify an individual user or associate your IP address with any other data held by Google®. We use reports provided by Google® Analytics to assist us in understanding website traffic and improving website usage. Third-Party Information Collection

When you use our Services, certain third parties may use automatic information collection technologies to collect information about you or your device. These third parties may include:

• Your mobile device manufacturer.
• Your mobile service provider.

Leachco Social Media Use

Leachco provides the opportunity to share and connect with third-party platforms such as Facebook, Twitter, Pinterest, LinkedIn, Tumbler, and Reddit. With the use of these various platforms, we encourage you to review each privacy policy before agreeing to their use on our site. Leachco may add additional social media plugins and integrations to our website from time to time.

Our Younger Customers

Children under the age of 18 may not register on Leachco.com, place an order, or participate in any activities related to Leachco.com marketing mailings. Although children under the age of 18 may visit Leachco.com, we encourage parents to view Leachco.com with their children and discuss with them the responsibilities of online usage. If Leachco.com should inadvertently collect information from a child under the age of 18, we will ensure that information is discarded. Parents or legal guardians have the responsibility to review their child’s information, request deletion, or withdraw authorization to allow further use of that personal information. If requested to remove data we will respond within a reasonable timeframe.   • You may access, correct, request deletion or request a copy of any or all of your personal information in our possession by emailing us at customerservice@leachco.com. We will respond within a reasonable timeframe. If we must incur expenses to comply with your request, we may charge you a reasonable fee to cover these expenses if permitted by law. If you believe any of the personal information is we have collected from you is inaccurate, you can email customerservice@leachco.com with a request to update this information. We will honor your requests within reasonable timeframe.
• Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies or block the use of other tracking technologies, some parts of our Services may then be inaccessible or not function properly.
• Promotion by Leachco. If you do not want us to use your email address or phone number to promote our own or third parties’ products or services, you can opt-out of our promotional emails and newsletter by unsubscribing or clicking on an opt-link within an email you receive. You can also always opt-out by logging into your User Account and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes or by sending us an email to customerservice@leachco.com.
• Disclosure of Your Information.If you do not want us to share your personal information with the third parties we use to support our services to you, please do not register with, access, or use our Services. Our services to you depend on other services provided by third parties. Please see the section of this Privacy Policy entitled [Disclosure of Your Information] for more information regarding access to, correction of, or deletion of personal information held by contractors, service providers, and other third parties we use to support our business.
• Targeted Advertising by Leachco. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers’ target-audience preferences, you can opt-out by selecting unsubscribe from marketing emails. You can also always adjust your user advertising preferences in your account profile by checking or unchecking the relevant boxes or by sending us an email to customerservice@leachco.com.

 We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (”NAI”) on the NAI’s website.

 

Accessing, Correcting Your Personal Information  

We retain your personal information for as long as necessary to provide you with our Services you have requested, or for other essential purposes such as complying with our legal obligations, resolving disputes, or enforcing our Terms. As discussed above, you may send us an email at customerservice@leachco.com to request access to, correct, or delete any personal information that you have provided to us. We will honor your requests within a reasonable timeframe.

 As discussed above, you may contact our third-party service providers directly to remove or update your personal information in the possession of such third-party service providers.

 If you delete your User Contributions, copies of your User Contributions may remain viewable in cached and archived pages or might have been copied or stored by other users of our Services.

As described above, we use your Personal Information to provide you with targeted periodic advertisements or marketing communications we believe may be of interest to you and with your permission.

Please note that the exchange of personal information with a service provider pursuant to a written contract that meets the requirements set by the CPRA (CCPA amendment), does not constitute a sale or sharing of your personal information.

Your right to opt out of the sale or sharing of your personal information and how you can exercise it

We share your personal information with the third parties listed in detail in the section titled “Detailed information on the processing of Personal Data” within this document. These third parties are grouped and categorized in accordance with the different purposes of processing.

You have the right to opt out of the sharing of your personal information. This means that whenever you request us to stop  sharing your personal information, we will abide by your request.
Such requests can be made freely, at any time, without submitting any verifiable request.

If you want to submit requests to opt out of the sale or sharing of personal information via a user-enabled global privacy control, like the Global Privacy Control (“GPC”), you are free to do so and we will abide by such request. The GPC consists of a setting or extension in the browser or mobile device and acts as a mechanism that websites can use to indicate they support the GPC signal. We use any personal information collected from you in connection with the submission of your opt-out request solely for the purposes of complying with the opt-out request.

The right to access personal information: the right to know and to portability

You have the right to request that we disclose to you:

The right of no retaliation following opt-out or exercise of other rights (the right to non-discrimination)

We will not discriminate against you for exercising your rights under the CPRA (CCPA amendment). This means that we will not discriminate against you, including, but not limited to, by denying goods or services, charging you a different price, or providing a different level or quality of goods or services just because you exercised your consumer privacy rights.

However, if you refuse to provide your personal information to us or ask us to delete or stop sharing your personal information, and that personal information or sale is necessary for us to provide you with goods or services, we may not be able to complete that transaction.

To the extent permitted by the law, we may offer you promotions, discounts, and other deals in exchange for collecting, keeping, or sharing your personal information, provided that the financial incentive offered is reasonably related to the value of your personal information.

How to exercise your rights

To exercise the rights described above, you need to submit your verifiable request to us by contacting us via the details provided in this document.

For us to respond to your request, it’s necessary that we know who you are. Therefore, you can only exercise the above rights by making a verifiable request which must:

• provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative;
• describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We will not respond to any request if we are unable to verify your identity and therefore confirm the personal information in our possession actually relates to you.

Making a verifiable consumer request does not require you to create an account with us. We will use any personal information collected from you in connection with the verification of your request solely for the purposes of verification and shall not further disclose the personal information, retain it longer than necessary for purposes of verification, or use it for unrelated purposes.

If you cannot personally submit a verifiable request, you can authorize a person registered with the California Secretary of State to act on your behalf.

If you are an adult, you can make a verifiable request on behalf of a minor under your parental authority.

You can submit a maximum number of 2 requests over a period of 12 months.

How and when we are expected to handle your request

We will confirm receipt of your verifiable request within 10 days and provide information about how we will process your request.

We will respond to your request within 45 days of its receipt. Should we need more time, we will explain to you the reasons why, and how much more time we need. In this regard, please note that we may take up to 90 days to fulfill your request.

Our disclosure(s) will cover the preceding 12-month period. Only with regard to personal information collected on or after January 1, 2022, you have the right to request that we disclose information beyond the 12-month period, and we will provide them to you unless doing so proves impossible or would involve a disproportionate effort.

Should we deny your request, we will explain you the reasons behind our denial.

We do not charge a fee to process or respond to your verifiable request unless such request is manifestly unfounded or excessive. In such cases, we may charge a reasonable fee, or refuse to act on the request. In either case, we will communicate our choices and explain the reasons behind it.

How to exercise your rights

For us to respond to your request, we need to know who you are.

We will not respond to any request if we are unable to verify your identity using commercially reasonable efforts and therefore confirm that the personal data in our possession actually relates to you. In such cases, we may request that you provide additional information which is reasonably necessary to authenticate you and your request.

Making a consumer request does not require you to create an account with us. However, we may require you to use your existing account. We will use any personal data collected from you in connection with your request solely for the purposes of authentication, without further disclosing the personal data, retaining it longer than necessary for purposes of authentication, or using it for unrelated purposes.

If you are an adult, you can make a request on behalf of a minor under your parental authority.

How and when we are expected to handle your request

We will respond to your request without undue delay, but in all cases and at the latest within 45 days of its receipt. Should we need more time, we will explain to you the reasons why, and how much more time we need. In this regard, please note that we may take up to 90 days to fulfill your request.

Should we deny your request, we will explain to you the reasons behind our denial without undue delay, but in all cases and at the latest within 45 days of receipt of the request. It is your right to appeal such decision by submitting a request to us via the details provided in this document. Within 60 days of receipt of the appeal, we will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If the appeal is denied you may contact the Attorney General to submit a complaint.

We do not charge a fee to respond to your request, for up to two requests per year. If your request is manifestly unfounded, excessive or repetitive, we may charge a reasonable fee or refuse to act on the request. In either case, we will communicate our choices and explain the reasons behind them.
